Privacy Policy

Clutch Digital Development LLC — Effective date: October 14, 2026

1. Who we are and what this policy covers

Clutch Digital Development LLC ("Clutch," "we," "us," or "our") provides website development, SmartSites, ecommerce development, digital marketing, search optimization, AI agents, CRM integrations, automation, and related services. This Privacy Policy describes how we handle personal information in connection with our website, inquiries, strategy call requests, communications, and our own business operations.

When we process personal information on a client's behalf, the client's privacy notice and our agreement with that client govern that processing. If you interacted with a business using a website, CRM, or AI agent we support, contact that business first about its use of your information. We assist our clients with requests as required by our agreements and applicable law.

2. Information we collect

Information you provide. We collect information you submit through forms, email, calls, messages, or service requests. This may include your name, email address, telephone number, company, website, service interests, business goals, appointment preferences, and the contents of your communications. If you become a client, we may also receive billing information, project materials, authorized account access, and information needed to deliver your services.

Technical and usage information. Our website and the providers supporting it may collect IP addresses, browser and device details, approximate location derived from an IP address, referring pages, pages viewed, timestamps, and interactions. Campaign links may supply advertising source, campaign, keyword, and other attribution information. Cookies and similar technologies are discussed below.

Communication and consent records. We may retain inquiry histories, message delivery information, consent selections and associated dates, withdrawal requests, and suppression records. If an interaction is recorded or transcribed, we provide notice and obtain consent where required before doing so.

Information from other sources. Depending on the service or campaign, we may receive business contact information, advertising interactions, referrals, public business information, customer data supplied by clients, and audience or buying-intent information from data and advertising providers. The sources and permissible uses depend on the particular service. Audience and intent signals are estimates and do not establish that a person has consented to outreach.

Please do not submit passwords, payment card details, government identifiers, medical records, or other sensitive information through general contact forms or AI demonstrations. If a project requires protected information, we must agree on appropriate handling arrangements first.

3. How we use information

We use information to respond to requests, arrange strategy calls, prepare proposals, deliver and support services, manage client relationships, administer billing, protect accounts and systems, prevent fraud, and maintain business records. We also use relevant information to understand website performance, measure campaigns, improve our services, and send service updates or marketing communications subject to applicable consent and opt-out requirements.

For audience and advertising engagements, authorized information may be used to build segments, match audiences, measure conversions, personalize campaigns, or support prospecting. These activities must follow the applicable agreement, privacy notices, platform rules, and legal requirements. We do not treat an inferred interest or a purchased contact record as permission to send automated marketing calls or texts.

4. Phone calls, text messages, email, and AI

When you separately opt in, Clutch may contact you about its services by phone, text, email, or automated technology, including artificial, prerecorded, or AI-generated voice calls, within the scope of your consent. Marketing consent is not a condition of purchasing. Merely visiting our website or accepting website terms does not provide marketing consent.

Text message frequency varies based on your interactions and preferences. Message and data rates may apply. Reply STOP to opt out of texts or HELP for assistance. You may also contact sales@clutchdd.com or 833-725-8824 to request help or revoke consent. We honor reasonable withdrawal requests as required by law. A final confirmation of an opt-out may be sent where permitted.

Use an unsubscribe link in a marketing email or contact us to stop marketing emails. Tell us if you no longer want marketing calls. We may continue necessary, non-marketing service communications where permitted. We retain limited suppression information to respect your preferences.

Mobile information and text messaging opt-in data and consent will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes. We may disclose the information needed to providers that deliver messages and support the messaging program, subject to appropriate restrictions, or as required by law. This restriction takes priority over broader sharing descriptions in this policy.

Where offered, AI tools may process information you provide to respond, qualify an inquiry, arrange follow-up, or create summaries and CRM records. Authorized technology providers may process that information to operate the feature. AI can make mistakes; request human assistance or verify important information with our team. Recording, transcription, and provider retention practices must be disclosed for the specific feature where applicable.

5. Cookies, analytics, and advertising

Cookies, pixels, tags, and similar technologies can support website functionality, security, preferences, analytics, attribution, and advertising. These technologies may collect identifiers and activity information and may link activity to a browser, device, account, or other information. Some advertising providers may recognize a device across websites.

You can manage or delete cookies through browser settings. Where available, use our website privacy or cookie controls to manage optional tracking. Blocking cookies may affect functionality. Browser controls alone may not stop every form of data collection. Where consent is required, optional technologies should operate only after the required choice has been made. See our Cookie Policy for details about the technologies in use.

6. How we disclose information

Service providers. We disclose information as needed to providers supporting hosting, CRM systems, scheduling, communications, AI functionality, analytics, payment processing, security, and professional services. They receive information appropriate to their role and the applicable contractual and legal requirements.

Advertising and audience services. Campaign identifiers, activity information, audience information, and conversion events may be disclosed to advertising or data partners for authorized targeting, matching, measurement, and related campaign activities. Such disclosures can constitute a sale, sharing, or targeted advertising under certain state privacy laws even when no money is exchanged.

Other disclosures. We may disclose information at your direction; to advisers; to comply with legal obligations; to protect rights, safety, or security; or in connection with a merger, acquisition, financing, or business transfer, subject to applicable protections. The mobile opt-in restrictions above continue to apply.

7. Retention and security

We retain personal information for as long as reasonably needed for the purposes described here, including service delivery, legal and tax requirements, disputes, security, and honoring communication preferences. Relevant factors include the type of information, our relationship with you, contractual requirements, and applicable retention obligations. Information in backups may persist until those backups are routinely overwritten or deleted.

We use reasonable administrative, technical, and organizational safeguards appropriate to the information and processing involved. No website, transmission, storage system, or service can be guaranteed completely secure.

8. Your choices and privacy requests

Depending on your location and the law that applies to us, you may have rights to confirm processing, access or obtain a copy of information, correct inaccuracies, delete information, withdraw consent, or opt out of sale, sharing, targeted advertising, or certain profiling. These rights have conditions and exceptions. We do not discriminate against you for exercising applicable privacy rights.

Send requests to sales@clutchdd.com with the subject "Privacy Request," or call 833-725-8824. Describe your request and enough information for us to locate the relevant record. We may verify identity or an authorized agent's authority using proportionate information. Do not send sensitive identification documents unless requested through an appropriate method. We respond within applicable legal deadlines. If an appeal right applies and we deny a request, reply to our decision requesting an appeal; we will provide the applicable process and response.

Where required by applicable law, we honor recognized browser opt-out preference signals, such as Global Privacy Control, for the processing they cover. A browser signal generally applies to that browser or device unless we can associate it with your other information as required by law. Cookie choices and marketing unsubscribes address different processing activities and may need to be managed separately.

9. Children and visitors outside the United States

Our website and business services are intended for adults and business representatives, not children under 13. We do not knowingly collect personal information from children under 13. Contact us if you believe a child has provided information so we can take appropriate action.

Clutch serves businesses in the United States. Information may be processed in the United States and other locations where authorized providers operate. Privacy laws may differ from those where you live. Where applicable law requires protections for international transfers, those requirements apply; use of the website alone does not waive them.

10. External services and policy changes

Other websites, social platforms, payment services, and independent third-party services have their own privacy practices. Review their notices when you use them. We may update this policy to reflect changes in our practices or legal requirements. We will update the effective date and provide additional notice or obtain consent where required for material changes.
